1.         Details of the application

 

The premises are three adjacent fields which lie to the west of Aveley Road next to a strip of land used for light aircraft, and the application relates to an event which will run from the 8th June 2012 to 10th June 2012 inclusive.

2.         Promotion of the Licensing Objectives

 

The applicant completed the operating schedule, which formed part of the application to promote the four licensing objectives. The Applicant also provided the Event Safety Guide and Production Manual, a comprehensive document which also formed part of the application.

 

The applicant acted in accordance with premises licence regulations 25 and 26 relating to the advertising of the application.  The required newspaper advertisement was installed in the Yellow Advertiser on Wednesday 8th February 2012. Public notices were displayed around the site on the sides accessible to the public as agreed with the Licensing Officer.

 

3.         Details of Representations

 

Valid representations may only address the four licensing objectives

 

There were three valid written representations against this application from interested parties. The representations outlined issues relating mainly to the licensing objective the prevention of public nuisance and public safety.

 

Councillor Linda Van den Hende attended the hearing, and expressed concern that the camp site which formed part of the application would generate noise and cause a disturbance to the local residents. There was also concern that the lighting to be erected by the applicant around the site would also cause a nuisance to local residents. She also expressed reservations regarding the access, of which there was only one off Aveley Road, to provide ingress and egress. This was along a poorly made road, with the designated car park being the field nearest to properties. There was an anticipation that there would be ingress and egress to and from the site at all hours. There was also concern that there would be an interaction between vehicles and pedestrians along the sole access.

 

The access was also a point of contention on the grounds of public safety. Also the use of the aerodrome club house as an assembly point in case of an emergency could lead to a clash between users of the aerodrome and people attending the festival. In the absence of public transport from the site to the nearest train/underground station there was a danger people would walk to the site, along roads with no footpaths. Councillor Van den Hende felt that this was an inappropriate site for such an event, and that the hours requested were excessive.

4.         Determination of Application

 

Decision

 

Consequent upon the hearing held on 14 March 2012, the Sub-Committee’s decision regarding the application for a Premises Licence for Damyns Hall Aerodrome was as set out below, for the reasons shown:

 

The Sub-Committee was obliged to determine this application with a view to promoting the licensing objectives, which are:

·                     The prevention of crime and disorder

·                     Public safety

·                     The prevention of public nuisance

·                     The protection of children from harm

 

In making its decision, the Sub-Committee also had regard to the Guidance issued under Section 182 of the Licensing Act 2003 and Havering’s Licensing Policy.

 

In addition, the Sub-Committee took account of its obligations under s17 of the Crime and Disorder Act 1998, and Articles 1 and 8 of the First Protocol of the Human Rights Act 1998.

Whether the granting of the premises licence would undermine the four licensing objectives.

 

 

 

 

Becky Sampson on behalf of the applicants stated:

  • This was the third year they had successfully run the GO.GO festival in previous years, and no issues had been raised by any of the authorities they had worked with;
  • The applicants had no connection with the aerodrome, and would not be using the clubhouse or any other of the aerodromes facilities, they would simply have a licence for three fields for the event;
  • They anticipated an attendance of 1,500 people each day;
  • They had met with the Safety Advisory group and all their concerns had been met;
  • They had been in communication with all the objectors.
  • They would be installing temporary lighting around the site, this would be sensitively placed to reduce the possibility of nuisance for local residents;
  • A shuttle bus will be provided between the train station and the site from 10.00am to 10.00pm on all three days, although a late service will be available if required;
  • The hard standing in the car park will be used as a drop off and pick up point for the shuttle bus;
  • Access at night time will be minimal;
  • There will be 24 hour security on the site;
  • If people were deemed unsafe to drive when attempting to leave the site by car they will be prevented from doing so. Security will have a breathalyser kit available;
  • The event does not include any flying activities;
  • There will be no pedestrians on the gravel path;
  • Signs will be erected on the approach road;
  • There will be limited activity on the site in the three days leading up to the event;
  • The licence is just for the three days of the event;
  • The military show at Damyns Hall attracts 20,000 visitors over the two days;
  • The event is for ladies and organised by ladies;
  • A 24 hour contact number will be provided to the council;
  • The event will be ticket only.

 

 

 

Having considered the representations and responses, the sub-committee found that many of the objections were based upon a misunderstanding that the application related to the Aerodrome itself, and was for a permanent licence, whereas it was limited to one weekend only. The event had been run previously without trouble or complaint, and the safety manual provided covered all areas that might give rise to concern. The Applicant clearly has experience in running festivals of this nature, and it could not see that any of the Licensing objectives would be negatively affected by the granting of the licence as applied for. The Applicant had written to all objectors and responded to their concerns, and had dealt with all concerns raised at the hearing. The Sub-committee was therefore prepared to grant the premises licence as submitted.
